A major development is underway in Floridaโs property insurance world. A Circuit Court recently granted a statewide temporary injunction blocking Citizens Property Insurance Corporation from forcing policyholders into the Division of Administrative Hearings (DOAH) arbitration process. The Court found Citizensโ arbitration scheme likely unconstitutional, violating due process and homeownersโ right of access to the courts.
Citizens appealed the ruling, which initially placed the injunction on hold. But in a new order dated August 21, 2025, the judge lifted that automatic stay. This means that no cases can proceed to DOAH until the appeals process runs its course.
